1. Why did we prepare this information?

The processing of your personal data must comply with the law, be secure and transparent, so we would like to inform you and ask you to read why and under what conditions we process personal data, including informing you of your rights related to the processing of personal data and how to exercise them. This is one of the elements implementing the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, commonly referred to as the General Data Protection Regulation (“GDPR”).

2. How did we obtain your personal data?

We receive them in connection with your purchases in the online store, as well as in other cases of contact with our company, for example, participation in promotions, expressing an opinion or participating in loyalty programs, competitions.

4. Purposes and grounds for processing your personal data

The purpose of data processing is the conclusion and performance of a contract to which you are a party or the performance of actions prior to the conclusion of a contract, including: sale of goods or services, provision of services by electronic means, such as a newsletter, account management on our website, implementation of loyalty programs, expression of opinions, ratings or comments, processing of various requests (e.g. via an online contact form), as well as ongoing contact with you in the above-mentioned respect. In such cases, the basis for data processing is the need to perform the contract or to perform actions necessary prior to the conclusion of the contract (Article 6 (1b) GDPR).

Therefore, in accordance with applicable law, the basis for data processing will also be the need to fulfill a legal obligation imposed on our online store (Article 6(1c) GDPR), in particular: issuing and storing invoices and accounting documents, handling complaints, providing data to government agencies within the limits and on the basis of legal provisions, such as for tax and accounting purposes.

We also process your personal data for the purposes specified below, based on the legitimate interests of the online store (Article 6(1f) GDPR):

  • improving the quality of goods or services by collecting opinions or satisfaction surveys;
  • managing activity on the site by monitoring it in order to improve the functionality of the service, analyze needs, and adjust advertisements in accordance with previously viewed content;
  • processing of messages, opinions or requests when they are not related to the performance of the contract;
  • protection of property, health and life by recording images (monitoring) of the premises of a stationary store and the area around the store;
  • fulfillment of your orders;
  • direct marketing of the services offered, other than the newsletter;
  • sending a newsletter.

If you consent to the processing of personal data, this consent will be the basis for the processing of data (Article 6(1a) GDPR), and the purpose of data processing will be specified in the content of this consent each time. Consent to the processing of personal data can be revoked at any time.

5. Is it mandatory to provide data?

Providing your personal data is a condition for concluding a contract. If required by law, we may require you to provide the data required by these rules, such as your taxpayer identification number. Refusal to provide data to the extent necessary to conclude or perform a contract and to the extent provided by law will prevent its conclusion. In the case of collecting personal data on the basis of consent, the provision of personal data is voluntary.

Consequences of failure to provide data depending on the purpose for which the data is provided:

  • inability to register in the online store;
  • inability to use the services of the online store;
  • inability to make purchases in the online store;
  • the inability to receive information about promotions or special offers offered in the online store.

6. Who has access to your personal data?

In connection with the processing of data for the purposes and on the basis described above (paragraph 5), personal data may be available to the following categories of recipients:

  • organizations that provide us with marketing services;
  • entities that operate our IT systems or support these systems;
  • government bodies or organizations performing public tasks;
  • supplier of the software required to launch an online store;
  • the entity delivering the goods;
  • payment provider;
  • accounting;
  • hosting provider;
  • people cooperating with us under civil law contracts, ensuring our current activities;
  • an organization that provides statistical services.

7. How long do we store personal data?

We will only process your data for as long as we have a legal basis to do so, i.e. until:

  • we will no longer have a legal obligation to process your data;
  • the parties will no longer be able to make, assert or defend any claims related to the agreement concluded with the online store;
  • you withdraw your consent to the processing of data if it served as the basis for this;
  • your objection to the processing of your personal data will be accepted - if the basis for processing your data was the legitimate interest of the administrator or if the data was processed for direct marketing purposes.

8. Information about profiling of your data

For the purposes described in paragraph 5, except for processing to fulfil a legal obligation, we profile your personal data, i.e. automatically analyse it to obtain information about your preferences or interests (e.g. to check which offer may suit you best). This processing will not entail any legal consequences and will not affect you in the same way.

9. Your rights regarding data processing

All persons whose personal data we process have the following rights under the GDPR:

  • the right of access to personal data;
  • the right to request correction (adjustment) of personal data if the data is incorrect or incomplete;
  • the right to request the erasure of personal data (the so-called "right to be forgotten") when: the data are no longer necessary for the purposes for which they were collected or otherwise processed, the data subject has objected to the processing of the data, the person on whom the data subject has withdrawn the consent on which the processing is based and there is no other legal basis for the processing, the data are processed unlawfully, the data must be erased to comply with a legal obligation;
  • the right to request restriction of processing of personal data where: the accuracy of the personal data is contested by the data subject, the processing is unlawful and the data subject objects to the erasure of the data and requests their restriction instead, the controller no longer needs the data for its own purposes, but the data subject needs them for the establishment, defence or exercise of claims, the data subject has objected to the processing of the data - until it is determined whether the legitimate grounds of the controller outweigh the grounds for objection;
  • the right to transfer the data to another controller or to you (in accordance with the principles set out in Article 20 of the GDPR);
  • If you have given consent to the processing of personal data, you have the right to withdraw it at any time (withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal).

Right to object

At any time, you may object – on grounds relating to your particular situation – to the processing of personal data based on the legitimate interests of warszawahookahhub.pl or the public interest (Article 6(1) and (e)f GDPR), including profiling, based on these provisions. Warszawahookahhub.pl will no longer process this personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or unless we demonstrate grounds for the establishment, exercise or defence of claims.

If we process personal data for direct marketing purposes, you have the right to object at any time to the processing of personal data for such marketing purposes, including profiling, to the extent that the processing is related to such direct marketing. Once you have objected, we will no longer process your data for such purposes.

It will be easier for you to exercise the above rights by submitting an application to the address specified in paragraph 4 of this information. When you submit a request, we may ask you to provide additional information to verify your identity. Complaint to the supervisory authority.
